How does a roof insurance claim work in Florida?

A Florida homeowner's policy covers sudden, accidental damage — a named storm, wind, hail, a tree — and does not cover age, wear or a roof that simply reached the end of its life. Notice of a new claim must generally be given within one year of the date of loss under the 2022 changes (SB 2-A). You pay your deductible: Florida law prohibits a contractor from paying, waiving or rebating any part of it.

How does a roof insurance claim work in Florida?

Can I claim if my roof is leaking?

It depends entirely on why it is leaking, which is the distinction carriers care about and homeowners rarely hear explained. A leak caused by a storm last Tuesday is a covered sudden event. A leak caused by twenty-year-old underlayment finally giving up is maintenance, and no policy in Florida covers that. The same hole in the same roof can be either, which is why the inspection that documents the cause matters more than the one that documents the damage.

What insurance generally does not cover

Age and wear. Pre-existing damage you did not report. Damage made worse because a leak was left running — carriers can and do reduce a settlement on that basis, which is why tarping is urgent even when the repair is not. Cosmetic granule loss with no breach. And on many Florida policies written since 2022, a roof past a stated age may carry actual cash value rather than replacement cost, which is a very different cheque.

The one-year clock

Under the 2022 changes (SB 2-A), notice of a new or reopened property insurance claim must generally be given within one year of the date of loss, and a supplemental claim within eighteen months. That is shorter than it used to be and shorter than most people assume. If a named storm went over your house and you have not had the roof looked at, the clock is already running.

Your deductible is yours — by law

Florida law prohibits a contractor from offering to pay, waive or rebate any portion of your insurance deductible (s. 489.147, F.S.). Anybody offering to "cover your deductible" or to "make it disappear in the paperwork" is proposing something illegal, and the exposure is not only theirs. On a hurricane claim the roof deductible question is separate again — see the deductible guide below.

What we do and what we do not

We inspect, photograph plane by plane, and give you a written report with the damage dated and described. That report is yours and it is what a carrier wants. What we do not do is file the claim for you, negotiate with your adjuster, or take an assignment of benefits — JAC does not accept AOB. The claim is between you and your insurer; the evidence is what we are for.

If the claim is denied

A denial is not always final, and the most common reason for one is documentation rather than merit. You can request the adjuster's report, ask for a reinspection, and engage a licensed public adjuster — who works for you, for a fee, and is regulated separately from contractors. What you cannot do is have the roofer argue it for you, which is the thing people most often expect.

Related questions

Can I make an insurance claim if my roof is leaking?

Only if the cause is a sudden, covered event rather than age or wear. The cause is what the carrier adjudicates, not the leak itself, so the documentation of what caused it is the part that decides the claim.

What is the most common damage insurance does not cover?

Age and wear, by a wide margin — a roof that has simply reached the end of its life is a maintenance item, not a peril. Second is damage worsened by delay, which is why an unaddressed leak can cost you part of a settlement you would otherwise have had.

What happens if a roof leak is left untreated?

Three things, in order: the decking softens, the insulation and ceiling go, and the carrier gains an argument that part of the loss was your failure to mitigate. Tarping is cheap and it protects the claim as much as the house.

Will insurance cover a 10-year-old roof?

Usually yes for sudden damage, and at replacement cost on most policies at that age. The age thresholds that change the answer in Florida tend to start around fifteen years — covered in the roof-age guide below.

Do you file the claim for me?

No. We inspect, photograph and write the report; you file. JAC does not accept assignment of benefits and does not negotiate with adjusters, which keeps the evidence independent of the money.

What we do
